FullMention is an AI-powered brand ranking tracker that monitors how brands appear in ChatGPT responses. The Service allows users to track keyword rankings, analyze brand visibility, and gain insights into AI-generated content recommendations. The Service utilizes OpenAI's API to perform tracking and analysis.

To use the Service, you must create an account and provide accurate, complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring your use of the Service complies with all applicable laws and regulations

Paid plan subscriptions are billed monthly or annually in advance. All payments are non-refundable unless otherwise required by law. We reserve the right to modify pricing with 30 days notice. Failure to pay may result in suspension or termination of your account.

All data collected, generated, processed, or stored through the Service, including but not limited to tracking results, analytics, rankings, insights, and any derivative data, is owned exclusively by FullMention. By using the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, analyze, aggregate, and commercialize all data associated with your use of the Service.

The Service, including its design, features, functionality, and content, is owned by FullMention and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our explicit written consent.

9. Limitation of Liability

To the maximum extent permitted by law, FullMention shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless FullMention, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees and court costs) arising from or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party. This includes, without limitation, any legal proceedings, regulatory actions, or disputes that result in costs to FullMention.

11. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Denmark. Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be resolved exclusively by the Danish courts. You hereby consent to the exclusive jurisdiction and venue of the courts in Denmark for all such disputes.
